Michigan No-Fault Maximum Benefit Increases

On October 1, 2018, the Department of Insurance and Financial Services (DIFS) issued Bulletin 2018-19-INS, which changed the monthly maximum Michigan auto insurance carriers must pay for both wage loss and survivors’ loss benefit claims.

For Michigan motor vehicle accidents that occur between October 1, 2018 to September 30, 2019, the monthly maximum will be $5,700 per single 30-day period. This is an increase from $5,451 for accidents that occurred between October 1, 2017 through September 30, 2018. The increase reflects changes in the cost of living.

The monthly maximum means individuals injured in a motor vehicle accident can receive up to $5,700 per month in lost wage benefits. It also means dependents claiming survivors’ loss benefits following a death from a motor vehicle accident can claim up to $5,700 per month in survivors’ benefits.

Under Michigan law, individuals who are disabled from working due to a car or truck accident, or a motorcycle accident that involves a car or truck, can receive lost wages for the income they would have earned if not for the accident. Under the statute, MCL 500.3107(1)(b), wage loss benefits are payable at 85% of gross pay for up to 3 years from the date of the accident.

For survivors’ loss claims, benefits are payable to dependents for “contributions of tangible things of economic value” for up to 3 years from the date of the accident. Although not defined in the Michigan no-fault law, contributions of tangible things of economic value includes lost wages as well as lost fringe benefits, such as a pension, investment income, annuity income and disability coverage.

Survivors’ loss benefits also includes replacement services for up to 3 years from the date of the accident.
