Why Do I Need a Lawyer After a Farmington Hills Car Accident?

Most of the time, a car accident in Farmington or Farmington Hills only involves minor damage and no injuries. However, if the crash is serious and an injury occurs, an experienced car accident lawyer is a good person to turn to ensure you don’t get taken advantage of by the insurance company.

A knowledgeable car accident attorney can help you open a claim for first-party benefits, as well as obtain money for the pain and suffering resulting from your injuries.

It is important to consult with a great Farmington Hills car accident lawyer who knows the tricks of the trade and how car insurance companies act. Just as importantly, you need an auto accident law firm that will consistently keep you updated on your case and has a history of obtaining large dollar settlements for clients.

What Compensation Can I Get From a Farmington Hills Car Accident?

Michigan is a no-fault state. This means you can obtain benefits from a car insurance company for injuries caused by an accident, even if you are at fault. These benefits are also available to those injured as pedestrians, bicyclists, and motorcycle riders, so long as a motor vehicle is involved in the accident.

The no-fault claims benefits available to people injured in a car or truck accident include:

  • Medical Expenses – This includes hospital bills, doctor’s bills, rehabilitation costs, surgery bills, prescriptions, and out-of-pocket costs. It also includes other medical expenses that health insurance does not cover.
  • Lost Wages – 85% of lost wages for up to 3 years from the date of the crash. This includes self-employed individuals and those paid under the table.
  • Replacement Services – Family members or friends who complete household chores, such as laundry, cooking, and other household chores.
  • Out-of-Pocket – reimbursement for co-pays, medical mileage, prescriptions, and other out-of-pocket expenses.

Who Pays First-Party No-Fault Benefits?

This is an important question. An injured person must file a first-party claim against the correct auto insurance carrier. Failing to do so can result in the loss of all no-fault benefits.

There is a priority order for determining which insurance carrier is responsible. The order is the following:

  1. Your own auto insurance - if you have car insurance of your own, your own car insurance company is responsible for paying PIP benefits. This is true even if your vehicle or vehicles had nothing to do with the accident. If you are a named insured on the policy, your auto insurance must pay all first-party benefits.
  2. The auto insurance company of a resident relative – this includes a spouse, sibling, child, parent, and possibly other relatives. Again, it doesn’t matter if their car had nothing to do with the crash. That insurance carrier must step up and pay all first-party benefits.
  3. The Michigan Assigned Claims Plan (MACP) – If an injured person does not have auto insurance and does not live with a relative who has car insurance, then they MUST turn to the Michigan Assigned Claims Plan, or the MACP. The Michigan Automobile Insurance Placement Facility runs the MACP.

To receive benefits through the MACP, a claimant must complete the Application for Benefits. Usually, a police report or some proof of the accident must also be provided. The application asks for a lot of information. An experienced Farmington Hills car accident law firm is highly recommended to assist you in making this claim.

How Much Time Do You Have to File a First-Party Claim?

Under Michigan law, specifically MCL 500.3145, a person must file a claim for no-fault benefits within one (1) year of the accident. The notice must be in writing, and the name and address of the claimant must be given. The notice must also indicate the name of the person injured, and the time, place, and nature of the injury.

This rule is strict. If a person fails to give proper notice to the correct insurance carrier within one year, they forever lose the right to seek no-fault benefits.

Pain and Suffering for a Farmington Michigan Car Accident

If another person causes the accident, such as by running a red light or making an illegal turn, the injured person can seek compensation for pain and suffering. This is a negligence claim, also known as a third-party claim. Both the driver and the owner of the at-fault vehicle are liable for paying these “non-economic damages.” They can include:

  • Pain and suffering
  • Emotional distress
  • Loss of society and loss of companionship
  • Depression and anxiety
  • Loss of quality of life; and
  • Mental suffering

The Lee Steinberg Law Firm understands the complexities of auto accident cases, the defenses insurance companies come up with, how to get Michigan no-fault benefits, and how to get the most for your pain and suffering.

What if the Negligent Driver is Uninsured?

Sometimes the negligent driver and owner of the at-fault vehicle are uninsured. In that situation, an injured person could file a lawsuit against the individual. However, good luck in collecting any money. This is where uninsured motorist benefits (UM) come into play.

Uninsured motorist coverage is insurance that a car owner buys from their own insurer. It provides payment for pain and suffering caused by an uninsured driver’s negligence.

Basically, if you are hurt in a car crash, and the at-fault driver has no insurance, your insurer steps in. It pays you for pain and suffering.

Deep Resources and Trial-Ready Representation

Successfully handling a serious car accident claim often requires far more than filing insurance paperwork. Insurance companies frequently invest substantial resources into limiting payouts and disputing claims. They may dispute liability, downplay the severity of injuries, or delay payments to pressure victims into accepting less than they deserve.

To effectively challenge them, accident victims need attorneys with the experience, resources, and determination to fight back. Our firm’s trial-tested strategies and in-depth understanding of insurance tactics give our clients a significant advantage in negotiations and courtrooms alike.

The Farmington car accident lawyers at Lee Steinberg Law Firm work with nationally recognized experts to build strong cases. For example, we work closely with investigators and experts to reconstruct the accident scene and identify any third parties who may share liability, such as commercial vehicle operators. We also retain economists and vocational experts to quantify lost future wages and future care needs, which is critical for clients facing lifelong disabilities.
